Introduction

  1. These terms of use apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms of use), and United Workers Alliance (“United Workers Alliance”, “we”, “us”, “our”), the owner and operator of this Website. Please read these terms of use carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms of use is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms of use, you should stop using the Website immediately.

  2. In these terms of use, User or Users means any third party that accesses the Website and is not either (i) employed by United Workers Alliance and acting in the course of their employment, or (ii) engaged as a consultant or otherwise providing services to United Workers Alliance and accessing the Website in connection with the provision of such services.

  3. You must be at least 16 years of age to use this Website. By using the Website and agreeing to these terms of use, you represent and warrant that you are at least 16 years old.


Legal notice – products and services

  1. United Workers Alliance operates as a consultancy, providing self-representation support, coaching, and unreserved legal services for individuals involved in workplace and Employment Tribunal matters. We are not a regulated law firm, we are not regulated by the Solicitors Regulation Authority (SRA), and we do not provide:

    • Reserved legal services (as defined in the Legal Services Act 2007),

    • Immigration services,

    • Claims management services,

    • Regulated financial services activities, or

    • Notarial services.

    If your matter requires any of the above, we will, where possible, signpost you to alternative regulated or specialist providers.

  2. Accordingly, we do not offer the following Reserved Legal Services:

    The reserved right to appear before and address a court, including the right to call and examine witnesses, except where permitted as a lay representative in tribunals or similar forums and subject always to the permission and rules of that forum.

  4. Conduct of litigation:

    The issuing of proceedings before any court in England and Wales; the commencement, prosecution, and defence of such proceedings; and the performance of any ancillary functions in relation to such proceedings (such as acting as the formal address for service or being recorded as the legal representative of record).

  5. Reserved instrument activities:

    Preparing any instrument of transfer or charge for the purposes of the Land Registration Act 2002; making an application or lodging a document for registration under that Act; preparing any other instrument relating to real or personal estate for the purposes of the law of England and Wales; or preparing instruments relating to court proceedings in England and Wales.

  6. Probate activities:

    Activities relating to the administration of a deceased person’s estate where these are reserved.

  7. Administration of oaths.

We support you by drafting, explaining, and coaching you to run your own case. You remain the litigant/party, and you are responsible for submitting documents and complying with formal requirements unless otherwise agreed with a regulated professional.

Professional indemnity and compensation schemes

  1. United Workers Alliance holds professional indemnity insurance in respect of the consultancy services we provide. Details of our current cover can be provided upon reasonable request.

  2. Any claim in relation to services provided by United Workers Alliance shall be made only against United Workers Alliance and not personally against any individual consultant, staff member, or contractor. As we are not regulated by the SRA, you cannot make a claim on the SRA Compensation Fund in relation to our services. That fund is only available to clients of law firms regulated by the SRA.

You represent and warrant that you own or otherwise control all the rights to any Content you post; that the Content is accurate; that use of the Content you supply does not violate these terms of use and will not cause injury to any person; and that you will indemnify United Workers Alliance for all claims resulting from Content you supply.


Confidential information

  1. Both United Workers Alliance and you understand that the other party may disclose business, technical, financial or other confidential, sensitive or proprietary information (“Confidential Information”). Confidential Information includes the information you provide to us as part of any enquiry or engagement, including documents you upload or share, and other non-public information which, given the circumstances of disclosure, a reasonable person would consider confidential. Both parties agree:

24.1. to take reasonable precautions to protect such Confidential Information; and

24.2. not to use (except in the performance of United Workers Alliance’s services or as otherwise permitted in writing) or divulge to any third person any such Confidential Information.

United Workers Alliance may, from time to time, use technology and/or artificial intelligence solutions provided by trusted third parties (for example, to record, transcribe or summarise meetings or calls, or to assist in document preparation). Where you agree to use such functionality, you accept that your Confidential Information and personal data may, by necessity, be processed by those third parties. Any such Confidential Information shared with third parties is disclosed only under binding contractual confidentiality obligations, and any personal data is processed in accordance with United Workers Alliance’s Privacy Policy.

  1. Clause 24 will not apply to any information that a party can prove:

25.1. is or becomes generally available to the public;

25.2. was in its possession or known to it prior to receipt from the other party;

25.3. was rightfully disclosed to it without restriction by a third party;

25.4. was independently developed without use of any Confidential Information of the other party; or

25.5. is required to be disclosed by law, court order or regulatory authority (in which case, where lawful, reasonable notice will be given to the other party).


Prohibited use

26.1. in any way which causes, or may cause, damage to the Website or interferes with any other person’s use or enjoyment of the Website;

43.2. loss or corruption of any data, database or software;

43.3. any special, indirect or consequential loss or damage.


General

  1. You may not transfer any of your rights under these terms of use to any other person. We may transfer our rights under these terms of use where we reasonably believe your rights will not be materially affected.

  2. We may vary these terms of use from time to time. The revised terms will apply to the Website from the date of publication. Users should check the terms of use regularly to ensure familiarity with the then-current version.
